Plaintiff Rick Perry alleged that Virginia's requirement for petition circulators to be either eligible or registered qualified voters in the state violated his freedom of speech and association. Plaintiff was unable to obtain a sufficient number of signatures from qualified voters for the Republican Party presidential primary ballot due to the Virginia State Board of Election's requirement regarding petition circulators.
