Filing 14 MEMORANDUM OPINION AND ORDER pursuant to the plaintiff's 11 letter-form notice that he does not wish to prosecute this civil action, to the extent that plaintiff's letter-form notice could be construed as a motion to voluntary dismiss hi s Complaint pursuant to Rule 41(a)(2), the Court further finds that permitting dismissal without prejudice under these circumstances is proper and GRANTS the motion; directing that this civil action be DISMISSED WITHOUT PREJUDICE as to all defenda nts; plaintiff need not make monthly payments of the filing fee as described in Magistrate Judge Tinsley's 7/21/2014 7 proposed findings and a recommendation; the Court DECLINES TO ADOPT AS MOOT the proposed findings and a recommendation.
