Filing 50 ** TEXT ONLY ORDER ** On December 17, 2014, the court held a telephonic hearing on plaintiff's motion to compel discovery (dkt. #43 ). After hearing from both sides, the court denied the motion as unnecessary, with one small exception, because defendant already has provided all of the responsive information that it possesses. The parties should be guided in future discovery by the court's comments during the hearing. As a general matter, notwithstanding the broad discovery that is expected and appropriate in patent litigation, plaintiff will have to tailor his discovery requests to the lawsuit he actually brought. By suing a Toyota dealership instead of the parent company that actually makes the new motor vehicles that the dealership sells--or the manufacturers of the used vehicles that the dealership sells--plaintiff cannot expect to obtain--and will not obtain--much of the information he seeks in his discovery requests. Plaintiff also will have to do a much, much better job in the future explaining and defending the relevance of contested discovery requests, even if the burden of production would not be particularly high. The court remains skeptical that plaintiff actually needs or will be able to use much of the discovery that he has requested, but because defendant has nothing left to give except some archived used vehicle advertising, the court's concerns were not subject to clear resolution at the hearing. Because plaintiff filed this motion so closely on the heels of the previous discovery motion, the court will not shift costs on this one either. Signed by Magistrate Judge Stephen L. After hearing from both sides, the court granted the motion in the manner and for the reasons stated. By way of brief synopsis, not later than December 19, 2014, the parties must submit either a joint proposed protective order or competing versions of a protective order. Not later than January 5, 2015, plaintiff must provide a response to every interrogatory and every request for production of documents propounded by defendant. As with all discovery, plaintiff has an ongoing duty promptly to supplement all of these responses as this case progresses. Defendant did not ask for cost shifting, so the court did not shift costs.
