REPORT AND RECOMMENDATIONS re 1 Inmate 1983 Complaint filed by Malcolm Williams, it is the Recommendation of the Mag Judge that: 1)The plaintiff's claims against the State of AL, Houston County and the Houston Co. Jail arising from conditions in the Houston County Jail be dismissed with prejudice pursuant to the directions of 28 USC 1915(e)(2) (B)(i) and (iii); 2) The plaintiff's challenge to the constitutionality of his confine resulting from a sentence imposed by the CC of Houston Co., AL be dismissed without prejudice pursuant to the provisions of 28 USC 1915(e)(2)(B)(ii); as such claims are not properly before the court at this time; 3) This case be dismissed prior to service of process in accordance with the directives as further set out in order; Objections to R&R due by 6/18/2007.
