RECOMMENDATION of the Magistrate Judge that: (1) plaintiff's claims against the Coffee County Sheriff's Department be dismissed with prejudice prior to service; (2) the Coffee County Sheriff's Department be dismissed as a party to this cause of action; (3) this case, with respect to the claims against the remaining defendants be referred back to the Magistrate Judge for appropriate proceedings.
