February 7, 2025 Opinion or Order Filing 74 ORDER ON LIMITED REMAND GRANTING A CERTIFICATE OF APPEALABILITY: COA is hereby GRANTED on the following issues: Whether the principles underlying the Supreme Court's decision in Loper Bright Enterprises v. Raimondo, 603 U.S. 369 (2024), impl y that AEDPA deference, which interprets 28 U.S.C. 2254(d), is unconstitutional. Whether Washington could have brought the foregoing claim before the district court entered final judgment on his habeas petition. Washington is not entitled to a COA wi th respect to any other issues that he may seek to appeal from this Court's denial of his Rule 59(e) motion.
