Filing 4 ORDERED that on or before January 24, 2019 the plaintiff shall file an amended complaint that: 1. Sets forth his claims addressing the medical treatment provided to him at Fountain which he believes violated his constitutional rights. 2. Names as defendants the individual(s) he contends are personally responsible for the alleged denial of adequate medical treatment. 3. Specifically describes how the defendant(s) named in the amended complaint deprived him of his constitutional rights when providing medical treatment to him. The amended complaint will supersede the initial complaint and this case will henceforth proceed only against the defendants named and claims presented in the amended complaint. The plaintiff is advised that if he seeks his release from incarceration due to the alleged unconstitutionality of his confinement, he may do so by filing a SEPARATE 28 U.S.C. 2254 petition with respect to the denial of parole by members of the parole board and the denial of good time credits by correctional officials as these claims are separate and distinct from each other. The proper respondent in a habeas action is the warden of the facility in which the plaintiff is confined. To aid the plaintiff in filing an amended complaint in response to this order, the Clerk is DIRECTED to provide him with a copy of the form used by prisoners to file complaints and the plaintiff shall utilize this form in filing his amended complaint. As set forth above, the amended complaint shall be limited to the medical treatment claims. The plaintiff is cautioned that if he fails to comply with the directives of this order the Magistrate Judge will recommend that this case be dismissed for such failure.
