Filing 10 ORDER: In the amended complaint, Plaintiff requests issuance of a preliminary injunction. Doc. #6 at 5. Accordingly, it is ORDERED that on or before 11/6/2020, Defendants shall file a response to the motion for preliminary injunction in which they SHOW CAUSE why this motion should not be granted. The Clerk is DIRECTED to provide a copy of this order and the request for preliminary injunctive relief (Doc. #6 ) and any attachments to this pleading via certified mail to General Counsel for the ADOC and General Counsel for Wexford Health Sources, Inc. The court is aware that counsel has not yet entered an appearance on behalf of the named Defendants, and infers no waiver of service on any Defendant simply because counsel is ordered to respond as set forth herein. Filing 8 ORDER ON MOTION: Before the court is Plaintiff's motion for extension of time. (Doc. #7 .) Plaintiff complains of prison officials failure to send a partial payment and appears to seek additional time to submit an initial partial filing fee. On 9/9/2020, the court granted Plaintiff leave to proceed in forma pauperis. (Doc. #4 .) The 9/9/2020 Order did not require payment of an initial partial filing but directed Plaintiffs custodians to collect the $350.00 filing fee from monies available to Plaintiff in accordance with the terms set forth in the Order. Because Plaintiff is not under order to submit an initial partial filing fee, his request for additional time to do so is not warranted. Accordingly, it is ORDERED that the motion for extension of time (Doc. #7 ) is DENIED. Signed by Honorable Judge Jerusha T. Adams on 10/16/2020. (dmn, ) |

The court will consider only those claims set forth and defendants named in the amended complaint. The amended complaint shall therefore supersede the original complaint.
