| Filing 4 FINAL JUDGMENT: The Plf, a state inmate, filed this 42 USC 1983 complaint on 1/28/2021. Prior to service of the complaint, the Plf filed a motion wherein he requests dismissal of this case. (Doc. #3 ). The Court construes the motion as a notice of dismissal pursuant to Fed. R. Civ. P. 41(a)(1)(A)(i), which permits voluntary dismissal by a plf "before the opposing party serves either an answer or a motion for summary judgment[.]" Pursuant to Fed. R. Civ. P. 41(a)(1)(B), such dismissal is "without prejudice." Because the notice of dismissal comports with Fed. R. Civ. P. 41(a)(1)(A)(i), the Plf's claims against the Dfts have been dismissed by operation of Rule 41(a)(1). DIRECTING the Clerk to enter this document on the civil docket as a final judgment pursuant to Rule 58 FRCP. This case is closed. Signed by Chief Judge Emily C. Marks on 3/8/2021.
