MEMORANDUM OPINION, AND ORDER Accordingly, the court GRANTS the motion for summary judgment on Count Five. III. CONCLUSION The court GRANTS the motion for partial summary judgment and ENTERS SUMMARY JUDGMENT in favor of Defendants and against Ms. Sm ith on Counts Three, Four, and Five. (Doc. 60). The court DENIES AS MOOT Mr. Palmers motion to dismiss. (Doc. 62). The court DIRECTS the Clerk to term Mr. Palmer as a defendant. Counts One and Two remain and will proceed to discovery.
