MEMORANDUM OPINION AND ORDER - For the reasons discussed above, the Court GRANTS Sergeant Palmers motion for summary judgment with respect to Mr. Scotts claims for false arrest and malicious prosecution under 42 U.S.C. § 1983 and Alabama law, an d with respect to Mrs. Scotts claim for outrage under Alabama law. These claims are DISMISSED WITH PREJUDICE. The Court DENIES Sergeant Palmers motion for summary judgment with respect to Mr. Scotts claims for excessive force under 42 U.S.C. § 1983 and assault and battery under Alabama law.
