March 5, 2019 Opinion or Order Filing 3 ORDER - Pro se plaintiff Summer Perry has asked for leave to proceed in forma pauperis, and she has asked the Court to appoint counsel to represent her. (Doc. #2 ). The Court finds that Ms. Perry is indigent and grants her motion to proceed in forma pauperis. The Court asks the Clerk to please file this action without prepayment of a filing fee. Ms. Perrys lawsuit involves violations of the Eighth Amendment and of 42 U.S.C. 1983 and a state law wrongful death claim based on a theory of negligence. (See Doc. #1 ). These claims are not so novel or complex that Ms. Perry requires assistance presenting them to the Court at this stage of the litigation.
