Filing 3 ORDER - Pro se plaintiff Summer Perry has asked for leave to proceed in forma pauperis, and she has asked the Court to appoint counsel to represent her. (Doc. #2 ). The Court finds that Ms. Perry is indigent and grants her motion to proceed in forma pauperis. The Court asks the Clerk to please file this action without prepayment of a filing fee. Ms. Perrys lawsuit involves violations of the Eighth Amendment and of 42 U.S.C. 1983 and a state law wrongful death claim based on a theory of negligence. (See Doc. #1 ). These claims are not so novel or complex that Ms. Perry requires assistance presenting them to the Court at this stage of the litigation. Therefore, the Court denies Ms. Perrys motion for appointment of counsel without prejudice. Signed by Judge Madeline Hughes Haikala on 3/5/2019. (KEK) |
