MEMORANDUM OPINION and ORDER that the defendant's motion for judgment on the pleadings is GRANTED in part and DENIED in part; all claims of race discrimination based upon a pattern-and-practice theory of discrimination are DISMISSED with prejudi ce; Plaintiff's disparate impact and disparate treatment theories of race discrimination remain pending, as does his age discrimination claim; it is further ORDERED that the stay on discovery is LIFTED and the parties are directed to proceed immediately to discovery on all remaining claims in accordancewith the Uniform Initial Order a more fully set out in order.
