March 2, 2015 26 Opinion or Order of the Court MEMORANDUM OPINION AND ORDER that the Motion to Dismiss is GRANTED in part and DENIED in part; the motion as to Limestone Correctional Facility is GRANTED, and all claims asserted against that entity are DISMISSED with prejudice; the motion based upo n defendants' sovereign immunity is GRANTED, and all claims for money damages asserted against the defendants in their official capacities are DISMISSED with prejudice; the motion as to plaintiff's claims for injunctive relief also is GRANT ED, and all claims for injunctive relief asserted against the above-named defendants are DISMISSED with prejudice; the motion to dismiss claims asserted against fictitious defendants is GRANTED, and those claims are STRICKEN; the motion is denied in all other respects; Defendants are allowed fourteen days from the date of this order to file answers to plaintiff's complaint as more fully set out in order.
