ORDER: This matter comes before the court on Plaintiff Willie McKinney Jr.'s unopposed Motion to Remand. (Doc. #3 ). Mr. McKinney contends that removal was improper under 28 U.S.C. 1441(b)(2) because he originally brought the case in a state in which a defendant is a citizen. Id. Defendant James Marion Roberson consents to remand this case. (Doc. #7 ). Accordingly, the court GRANTS the motion and REMANDS the case to the Circuit Court of Sumter County.
