Order re: 126 Proposed Consent Decree filed by City of Daphne, Alabama. The Court finds that a consent decree is not appropriate in this case, as set out. A Rule 41 dismissal with prejudice, based on the fact of settlement, is the proper vehi cle with which to dispose of this case.
