Filing 129 ORDER The reference to the Magistrate is withdrawn as to Plaintiff's Motion for Finding of Contempt (Doc. 105) and Defendants' Motion for Summary Judgment (Doc. 119). Plaintiff's Motion for Finding of Contempt (Doc. 105) is granted in part and denied in part as set forth in this Order. Defendants must comply with the Court's October 15, 2010 Order directing that Defendants and ADC officials use side-cuff restraints when cuffing or restraining Plaintiff during transport or any other time. Defendants' Motion for Summary Judgment (Doc. 119) is granted in part and denied in part as follows: (a) the motion is granted as to Count I; (b) the motion is granted as to the conditions-of confinement claims in Count II; (c) the motion is denied as to the medical-care/side-restraints claim in Count II as to Deputy Warden Freeland.
