Filing 47 ORDER that the reference to the Magistrate is withdrawn as to Defendants' 43 Motion for Summary Judgment. Defendants' 43 motion is granted. Plaintiff's claims that he was denied cleaning supplies for the recreation pen, that he was denied clothes for recreation, and that he was subjected to constant cell illumination are dismissed without prejudice for failure to exhaust administrative remedies; all other claims are dismissed with prejudice. The Clerk of Court must enter judgment accordingly and terminate the action. Pursuant to 28 U.S.C. § 1915(a)(3), an appeal from the judgment in this action would not be taken in good faith. Dfts ADOC and Dennis Kendall are dismissed from this action for failure to state a claim upon which relief may be granted. Dfts Charles L Ryan, A Ramos, Lewenski, J Freeland, H Matson, J James, and R Patton must answer Count I of the Complaint (Doc. 1 ) and Dfts Charles L Ryan, J Freeland, and A Ramos must answer the conditions-of-confinement claim in Count II of the Complaint (Doc. 1 ). The Clerk of Court must send Pla a service packet including the Complaint (Doc. 1 ), this Order, and both summons and request for waiver forms for Dfts Charles L Ryan, A Ramos, J Freeland, H Matson, J James, R Patton, a nd Lewenski. Pla must complete and return the service packet to the Clerk of Court within 21 days of the date of filing of this Order. Dfts Charles L Ryan, A Ramos, J Freeland, H Matson, J James, R Patton, and Lewenski must answer the Complaint or ot herwise respond by appropriate motion within the time provided by the applicable provisions of Rule 12(a) of the FRCivP.
