ORDER - IT IS ORDERED: (1) The reference to the Magistrate Judge is withdrawn as to Defendants' Motion for Summary Judgment (Doc. 82 ) and Plaintiff's Motion for Ruling (Doc. 97 ).(2) Defendants' Motion for Summary Judgment (Doc. 82 ) is granted. (3) Plaintiff's Motion for Ruling (Doc. 97 ) is denied as moot. (4) The Clerk of Court must enter judgment accordingly and terminate the action. Signed by Judge David G Campbell on 4/16/13. (LAD)

ORDER Counts One and Four are dismissed without prejudice. Defendants Harris and Feehan are dismissed without prejudice. Defendants Barrigan, Spencer, and Barklay must answer Counts Two, Three, and Five of the First Amended Complaint. Plaintiff' s 12 Motion for Appointment of Counsel is denied without prejudice. The Clerk of Court must send Plaintiff a service packet including the 11 First Amended Complaint, this Order, and both summons and request for waiver forms for Defendants Barriga n, Spencer, and Barklay. Plaintiff must complete1 and return the service packet to the Clerk of Court within 21 days of the date of filing of this Order. This matter is referred to Magistrate Judge Jay R. ORDER that Plaintiff's Second 7 Motion for Leave to Proceed in forma pauperis is granted. The 1 Complaint is dismissed for failure to state a claim. Plaintiff has 30 days from the date this Order is filed to file a first amended complaint in compliance with this Order. If Plaintiff fails to comply, the Clerk of Court must, without further notice, enter a judgment of dismissal of this action with prejudice that states that the dismissal may count as a "strike" under 28 U.S.C. § 1915(g).
