Defendants Barrigan, Spencer, and Barklay must answer Counts Two, Three, and Five of the First Amended Complaint. Plaintiff' s 12 Motion for Appointment of Counsel is denied without prejudice. The Clerk of Court must send Plaintiff a service packet including the 11 First Amended Complaint, this Order, and both summons and request for waiver forms for Defendants Barriga n, Spencer, and Barklay. Plaintiff must complete1 and return the service packet to the Clerk of Court within 21 days of the date of filing of this Order. This matter is referred to Magistrate Judge Jay R.
