ORDER denying 20 Defendants' Motion to Dismiss the Complaint for Failure to State a Claim. Plaintiff must provide a preliminary expert opinion affidavit to Defendants, on or before Wednesday, August 22, 2012. The Court stays this action pendi ng Plaintiff's filing a notice of compliance with this Order on or before Wednesday, August 22, 2012. The failure to comply with A.R.S. § 12-2602(B) and this Order may result in sanctions, including but not limited to, the dismissal of th is action or the preclusion of Plaintiff's standard-of-care expert in this lawsuit. IT IS FURTHER ORDERED that, because the briefing is adequate and oral argument would not aid the Court, Defendants' request for oral argument is DENIED.
