FINAL ORDER AND JUDGMENT. The Court finds that the Lawsuit satisfies the applicable prerequisites for class action treatment. The Settlement Agreement shall be deemed incorporated herein, and the proposed settlement are finally approved and shall be consummated in accordance with the terms and provisions thereof, except as amended by any order issued by this Court. Van Ru shall establish a $2,300,000 Settlement Fund. Plaintiff, Nivea Ritchie, shall receive the sum of $12,000. T he Lawsuit is hereby dismissed with prejudice in all respects, with the Court specifically retaining jurisdiction to award attorneys' fees, costs, expenses, and disbursements to Class Counsel. Plaintiff's request for an award of attorney s' fees of 28% of the Settlement Fund, or $644,000.00, is approved.
