ORDER granting in part and denying in part Matthews' 46 Motion to Intervene. Matthews is granted leave to intervene solely with respect to its right to physical occupancy or possession of the Leased Property. It will not be permitte d to intervene in order to collect past-due rents. The Receiver shall file a notice with the court within 10 days of the entry of this order detailing the date of its expected vacancy of the Leased Property. Nothing in this order shall be construed as giving the Receiver any greater rights with respect to the Leased Property than that of the original lessee. Plaintiff shall lodge with the court an updated proposed form of Preliminary Injunction, consistent both with the TRO and this order by February 15, 2013. The defendant may st ipulate to the form. Otherwise defendant shall have 10 days after the lodging of the proposed form of Preliminary Injunction to file objections to the form.
