March 6, 2014 12 Opinion or Order of the Court ORDER: Counts I and II are dismissed without prejudice. Defendant Ferree is dismissed without prejudice. Defendants' Motion to Stay/Motion to Dismiss 10 is denied as premature. This case is stayed pending the resolution of Plaintiff's criminal case currently pending in the Maricopa County Superior Court, case #CR2012-007199-001. The Clerk of Court must indicate on the docket that this case is stayed. Within 90 days, Defendant Imdorf must file with the Court a "Notice of St atus" that informs the Court of the status of Plaintiff's criminal case currently pending in the Maricopa County Superior Court, case #CR2012-007199-001. Defendant Imdorf must file a "Notice of Status" within 15 days after entr y of judgment in Maricopa County Superior Court case #CR2012-007199-001. December 9, 2013 7 Opinion or Order of the Court ORDER : Plaintiffs Motion for Leave to File an Amended Complaint 4 is granted insofar as the Amended Complaint supersedes the original Complaint in its entirety and the Clerk of Court must file the lodged Amended Complaint (lodged at Doc. 5) as Pl aintiff's First Amended Complaint. The First Amended Complaint (lodged at Doc. 5) is dismissed for failure to comply with Rule 8 of the Federal Rules of Civil Procedure. Plaintiff has 30 days from the date this Order is filed to file a second amended complaint in compliance with this Order. If Plaintiff fails to file an amended complaint within 30 days, the Clerk of Court must, without further notice, enter a judgment of dismissal of this action without prejudice. Defendants' Motio n to Dismiss for Failure to State a Claim 3 and Motion for a Stay or in the Alternative, Motion for Screening 6 are denied as moot.
