Plaintiff's 1 Complaint is DISMISSED (without prejudice to filing an amended complaint) with leave to file an amended complaint within 14 days of the date of this Order. If Plaintiff chooses not to file an amende d complaint within this deadline, the Clerk shall dismiss this action with prejudice and shall enter judgment accordingly. If Plaintiff chooses to file an amended complaint, the complaint may not be served until and unless the Court screens the amended complaint; accordingly, Plaintiffs 4 motion for the Court to order service by the U.S. Marshals is denied without prejudice.
