ORDER: Defendants' 10 Motion to Dismiss is granted because the court lacks subject matter jurisdiction over plaintiffs' claims for declaratory and injunctive relief. Because the court would decline to exercise its jurisdiction over plaintiffs' claim for declaratory relief, leave to amend would be futile and is denied.
