Filing 24 ORDER Defendants move to dismiss plaintiffs amended complaint (filed in state court). Defendants' Rule 12(e) and Rule 12(f) motions are denied. Defendants' Rule 12(b)(6) is granted as to Mr. Trompetter. All of plaintiff's claimsagainst Mr. Trompetter are dismissed. Defendants' Rule 12(b)(6) is denied in part and granted in part as to Mr. Valles. Defendants' Rule 12(b)(6) motion as to Gyrus Logic is granted in part and denied in part. Defendants' Rule 12(b)(6) motio n is granted as to Mr. Dale, Mrs. Trompetter, and Mrs. Valles. All of plaintiff's claims against these defendants are dismissed. Plaintiff's amended complaint, should plaintiff elect to file one, shall be filed on or before October 23, 2014. Defendants' request for attorney fees is denied.
