RID is entitled to partial summary judgment on Count I of SRP's counterclaim to the extent that the Contracts at issue are not authorized by the Warren Act as a matter of law. The balance of RID's Motion is denied. IT IS FURTHER ORDERED denying Defendants and Counterclaimants Salt River Project Agricultural Improvement and Power District and Salt River Valley Water Users' Association's Motion for Partial Summary Judgment.
