P. 56 for Summary Judgment on Contract Interpretation is granted and Plaintiff's 84 Cross Motion for Summary Judgment on Contract Interpretation is denied. ORDER ED the Clerk enter judgment against Plaintiff Colocation America Corporation on its complaint and in favor of Defendant Mitel Networks Corporation and that Plaintiff take nothing. IT IS FURTHER ORDERED the Clerk enter judgment in favor of Counte rclaimant Mitel Networks Corporation on its counterclaim and against Counterdefendant Colocation America Corporation, declaring that the Domain Name Assignment Agreement is rescinded and terminated based on Colocation's material breach of the Agreement.
