ORDER (Service Packet): Plaintiff's Application To Proceed in District Court Without Prepaying Fees or Costs #7 is granted. The Clerk of Court must send Plaintiff a service packet including the First Amended Complaint #6 , this Order, and summons forms for Defendants Broe, Miranda, Gonzales, Hamidi, and Kirby. Plaintiff must complete and return the service packet to the Clerk of Court within 21 days of the date of filing of this Order. The United States Marshal will not provide service of process if Plaintiff fails to comply with this Order. If Plaintiff does not either obtain a waiver of service of the summons or complete service of the Summons and First Amended Complaint on a Defendant within 90 days of the filing of the First Amended Complaint or within 60 days of the filing of this Order, whichever is later, the action may be dismissed as to each Defendant not served. The Clerk of Court must send by certified mail a copy of the Summons for each individual Defendant, the First Amended Complaint, and this Order to (1) the civil process clerk at the office of the United States Attorney for the District of Arizona and (2) the Attorney General of the United States, pursuant to Rule 4(i)(1) of the Federal Rules of Civil Procedure. Defendants Broe, Miranda, Gonzales, Hamidi, and Kirby must not answer the First Amended Complaint until ordered to do so by the Court. Within 60 days after service or waiver of service, Defendants Broe, Miranda, Gonzales, Hamidi, and Kirby must file and serve a brief addressing whether Plaintiff may pursue injunctive relief under 28 U.S.C. 1331 against privately employed personnel working at a privately operated federal prison. Within 30 days after service of the brief, Plaintiff must file and serve a responsive brief. Within 15 days after service of the responsive brief, Defendants may file and serve a reply brief, if Defendants so desire. The Clerk of Court must correct the docket to reflect that the Cause is 28:1331 Federal Question: Bivens Act. Signed by Judge Dominic W Lanza on 12/21/2018. (REK)
