ORDER - IT IS HEREBY ORDERED that Plaintiff's Amended Application to Proceed in District Court without Prepaying Fees or Costs (Doc. #7 ) is granted. IT IS FURTHER ORDERED that Plaintiff shall file an amended complaint complying with this Order within twenty-one (21) days of the date of this Order. IT IS FURTHER ORDERED that if Plaintiff wishes to file an amended complaint, Plaintiff's first amended complaint should include the caption and civil case number used in this Order, No. CV-18-4686-PHX-DMF, and the words FIRST AMENDED COMPLAINT as the title on the first page. IT IS FURTHER ORDERED that if Plaintiff does not file an amended complaint that complies with the instructions in this order, within twenty-one days of this Order, the assigned magistrate judge will issue a Report and Recommendation recommending that the Complaint be dismissed pursuant to 28 U.S.C. 1915(e) and Rule 41(b). IT IS FURTHER ORDERED that failure of Plaintiff to timely comply with Orders of this Court may result in the dismissal of Plaintiff's Complaint without prejudice by the District Judge pursuant to Rules 12(b)(1), (6), (h)(3), 41, Fed. R. Civ. P.; 28 U.S.C. 1915(e)(2)(B)(iii); and/or pursuant to the Court's inherent power. IT IS FURTHER ORDERED denying the motion to file non-electronic exhibit to the complaint (Doc. #3 ).
