ORDER granting #2 Motion for TRO: On November 16, 2019, Petitioner Imran Haroon Ansari (also known as Sheriff Sultan Maknojiya) (AO78-505-565), who is represented by counsel, filed a Petition for a Writ of Habeas Corpus pursuant to 28 U.S.C. Section 2241 (Doc. 1) and a Motion for Temporary Restraining Order and/or Preliminary Injunction (Doc. 2). Petitioner seeks a TRO enjoining his removal pending consideration by this Court of his claims of denial of due process in his immigration proceedings. Specifically, Petitioner alleges that immigration officials have pursued expedited removal despite irregularities in confirming Petitioner's identity and obtaining travel documents on his behalf. Further, Petitioner maintains that his removal before adjudication of his Motion to Reopen his immigration proceedings currently pending before the BIA would violate due process. Having taken the matter under consideration, IT IS THEREFORE ORDERED (1) Petitioner's Motion for Temporary Restraining Order and/or Preliminary Injunction (Doc. 2) is granted to the extent it seeks a Temporary Restraining Order only. Respondents are enjoined from detaining and removing Petitioner Imran Haroon Ansari (also known as Sheriff Sultan Maknojiya) (AO78-505-565) from the United States until after the Court resolves the underlying Motion for Preliminary Injunction. The Court will set a hearing on the request for Preliminary Injunction by separate order if necessary. (2) The Clerk of Court shall email a copy of this Order to the United States Attorney for the District of Arizona, to the attention of Peter Lantka at peter.lantka@usdoj.gov and Mary Finlon at mary.finlon@usdoj.gov and to Petitioner's counsel Karina Ordonez at karina@karinaordonez.com. (3) Respondents must file a response to the Motion for Preliminary Injunction (Doc. 2) no later than 5:00 p.m. on Friday, November 22, 2019. (4) Petitioner may file a reply to the response to the Motion for Preliminary Injunction no later than 5:00 p.m. on Monday, November 25, 2019. (5) The Clerk of Court shall serve: (1) a copy of the Summons, (2) the Petition (Doc. 1), (3) the Motion for Preliminary Injunction and/or Temporary Restraining Order (Doc. 2), and (4) this Order upon the United States Attorney for the District of Arizona by certified mail addressed to the civil process clerk at the office of the United States Attorney pursuant to Rule 4(i)(1)(A) of the Federal Rules of Civil Procedure. The Clerk of Court shall also send by certified mail a copy of the Summons, the Petition, the Motion for Preliminary Injunction and/or Temporary Restraining Order, and this Order to the United States Attorney General pursuant to Rule 4(i)(1)(B) and to Respondents pursuant to Rule 4(i)(2) of the Federal Rules of Civil Procedure. (6) Respondents shall have 30 days from the date of service to answer the Petition (Doc. 1) Respondents shall not file a dispositive motion in place of an answer absent leave of Court. (7) Petitioner shall have 15 days from the filing of Respondents' Answer to the Petition to file a Reply. (8) Petitioner must file a Notice of Change in Status with the Clerk of Court within 5 days of any material change in Petitioner's immigration or custody status.
