(Doc. #12 .) The parties are reminded that pursuant to LRCiv 15.1(b), leave of Court is not needed when filing an amended pleading with the opposing party's written consent, such that a "stipulation for leave to amend" is never appropriate. That aside, IT IS ORDERED that the parties' stipulation (Doc. #12 ) is granted. Plaintiff shall have until December 22, 2021, to file an amended complaint with Defendants' written consent or, if amendment will be opposed despite good-faith conferral, a motion for leave to amend. Defendants' deadline to respond to the complaint or amended complaint, whichever is then operative, is extended to January 21, 2022. Ordered by Judge Dominic W Lanza on 11/23/21.
