March 25, 2025 Opinion or Order Filing 21 ORDER: Defendants Kris Mayes and State of Arizona move for an extension of time in which to file a motion to dismiss. (Doc. #20 .) They seek a "2-day extension in order to have time to meet and confer with Plaintiffs[.]" (Id. at 1.) Plaintiffs do not object to the request. For good cause shown, the Court will grant Defendants motion and afford them until March 28, 2025 in which to answer or otherwise respond to the complaint. The Court draws attention to the way it has worded this order. Defendants' motion and proposed order contemplate a 2-day extension in which to file a motion to dismiss. That language presupposes that a motion to dismiss will be filed, which, in turn, presupposes that the parties' meet and confer efforts will be fruitless. The Court expects the parties to meet and confer in good faith and, if the complaint can be cured in any part by the filing of an amended pleading, to stipulate to such an amendment in order to avoid needless motion practice. This holds true even if the proposed amendment would merely narrow the issues to be raised in a motion to dismiss, rather than obviate the need for the motion entirely.
