ORDER that 8 Plaintiff's Amended Complaint is dismissed. Plaintiff is granted leave to file a second amended complaint by June 9, 2017. If Plaintiff elects to file a second amended complaint, the complaint may not be served until and unless the Court screens the second amended complaint. Clerk must enter dismissal if Plaintiff fails to file an amended complaint. Plaintiff's Motion to appoint counsel (Doc. 8 at 8) is denied and Plaintiff's second Application to Proceed in District Court Without Prepaying Fees and Costs (Doc. 9 ) is denied as moot.
