December 20, 2012 Opinion or Order Filing 138 ORDER: IT IS ORDERED Plaintiffs 85 , 112 Motions for Default Judgment, Sanctions, and to Strike are GRANTED IN PART AND DENIED IN PART. Partial Default Judgment is awarded in favor of Plaintiff and against Defendant as to Plaintiff's claim re garding the 30,000 shares of LSI stock as stated in Count II of Plaintiff's Amended Complaint. Plaintiff is awarded monetary sanctions for the spoliation of evidence in the amount of $10,000. Defendant shall pay the monetary sanction within 30 days of the date of this Order. Plaintiffs 61 Motion for Partial Summary Judgment, Defendants 72 Cross-Motion for Partial Summary Judgment, and Plaintiffs 112 request for disclosure and to strike declarations are DISMISSED AS MOOT. Parties shall file briefs addressing the appropriate procedure to follow to determine damages by 1/22/13. Plaintiffs 134 Motion for Hearing is DENIED. Plaintiffs 135 Motion for Extension of Time is GRANTED IN PART AND DENIED IN PART. Parties shall disclo se names of all fact witnesses to be used at trial, by 1/7/13. Plaintiff shall file any response to Defendants Motion for Summary Judgment on by 1/22/13. Defendant shall file any reply on or before 2/8/13.
