ORDER ADOPTING REPORT AND RECOMMENDATION: IT IS ORDERED that the 112 , 115 Motions for Hearings are DENIED, and the 119 Motion to Strike Supplement is DENIED. The 110 Magistrate Judge's Report and Recommendation is accepted and adopted as the findings of fact and conclusions of law of this Court; the 113 Magistrate Judge's Report and Recommendation is accepted and adopted as the findings of fact and conclusions of law of this Court. The Plaintiffs 66 Motion for Summary Judgm ent for partition by sale is GRANTED for the appointment of a commissioner to sell the property and deposit the proceeds into the Court for distribution to be made by the Court to the parties. Within 10 days of the filing date of this Order, the Plai ntiffs shall file a Notice giving the name of the commissioner to be appointed by the Court to conduct the sale of the property.
