After a full and independent review of the record, in respect to the objections, the Magistrate Judge's 28 Report and Recommendation is accepted and adopted as the findings of fact and conclusions o f law of this Court. IT IS FURTHER ORDERED the 1 Petition for Writ of Habeas Corpus is DENIED. The 27 Motion for Judgment in a Civil Case is GRANTED. Clerk of the Court shall enter Judgment for Defendant and against Plaintiff. IT IS FURTHER OR DERED that in the event the Plaintiff, proceeding here in forma pauperis under 28 U.S.C. § 2241, should file an appeal, the Court finds the appeal is not taken in good faith. 28 U.S.C. 1915(a)(3) and FRAP 24(a). A party may respond to another party's objections within 14 days after being served with a copy. No replies shall be filed unless leave is granted from the District Court. If objec tions are filed, the parties should use the following case number: CV-12-648-TUC-DCB. Failure to file timely objections to any factual or legal determination of the Magistrate Judge may result in waiver of the right of review.
