Filing 26 ORDER re 24 Report and Recommendation: It is ordered that after a full and independent review of the record in respect to the objections, the Magistrate Judge's Report and Recommendation (Doc. 24 ) is accepted and adopted as the findings o f fact and conclusions of law of this Court. Petition Under 28 U.S.C. § 2254 for a Writ of Habeas Corpus by a Person in State Custody (Doc. 1 ) is DENIED. The Clerk of the Court shall enter Judgment accordingly. In the event Petitioner files a n appeal, the Court declines to issue a certificate of appealability, because the Petitioner failed to make a substantial showing of the denial of a constitutional right, and reasonable jurists would not find the Court's procedural rulings debatable.
