ORDER that Plaintiff's Complaint is DISMISSED sua sponte for lack of subject matter jurisdiction, without prejudice to Plaintiff filing of an Amended Complaint. It is further Ordered that Plaintiff's Motion for [Preliminary] Injunction Cease and Desist (Doc. #5 ) is DENIED. It is further Ordered that the Motion to Dismiss or Alternatively for a More Definite Statement (Doc. #8 ) is DENIED AS MOOT. It is further Ordered that the Plaintiff may file an Amended Complaint within 14 days of the filing date of this Order. It is further Ordered that the Clerk of the Court is directed to DISMISS all claims and to close this case, without further notice to Plaintiff, if Plaintiff fails to file the Amended Complaint within the 14-day time period set above. It is further Ordered that the Defendants need not respond to the Complaint; the time for filing a responsive pleading shall begin to run upon the filing of an Amended Complaint.
