ORDER FOR PAYMENT OF INMATE FILING FEE: IT IS ORDERED The Director of the Arizona Department of Corrections or designee must forward to the Clerk of Court the initial partial filing fee of $93.10. The balance of $350.00 filing fee must be collected from Plaintiff's trust account in monthly payments of 20% of the preceding month's income credited to the account. Payments must be forwarded to Clerk of Court each time the amount in the account exceeds $10, and payments must be clearly identified by name and number assigned to this action. Director of the Arizona Department of Corrections or designee must notify Clerk in writing when Plaintiff is released or transferred to a correctional institution other than the Arizona State Prison Complex-Tucson. Clerk must serve by mail a copy of this Order on the Director of the Arizona Department of Corrections, 1601 West Jefferson, Phoenix, Arizona, 85007, and forward a copy of this Order to Financial Administration for the Tucson Division of the United States District Court for the District of Arizona. As required by the accompanying Order to the appropriate government agency, Plaintiff must pay $350filing fee and is assessed an initial partial filing fee of $93.10. Count Three is dismissed insofar as it is asserted against Defendants Bell, Corizon, Centurion, Consolacion, and Riley. Defendants Bell, Corizon, Centurion, Consolacion, Riley, and Shinn must answer the Complaint. Plaintiff's #2 Motion for Temporary Restraining Order and Preliminary Injunction is DENIED in part as to Plaintiff's request for a temporary restraining order. The #2 Motion is taken under advisement with respect to Plaintiff's request for a preliminary injunction. Clerk must send Plaintiff a service packet including the #1 Complaint, the #2 Motion for Temporary Restraining Order and Preliminary Injunction, the #3 Declaration in Support, this Order, and both summons and request for waiver forms for Defendants Bell, Corizon, Centurion, Consolacion, Riley, and Shinn.
