(IN CHAMBERS) ORDER REQUIRING SUPPLEMENTAL BRIEFING ON MOTION TO REMAND (DKT. #10 ) by Judge John A. Kronstadt: Based on a review of the briefing on Petitioners' Motion to Remand ("Motion" (Dkt. #10 )), as well as Petitioners' Ex Parte Application to Advance the Hearing Date on the Motion ("Application" (Dkt. #19 )), further submissions are required. Silverman, who removed this action, is not currently named as a defendant. Therefore, supplemental briefing is warranted as to whether, at the time of removal, Silverman had standing or was otherwise permitted to cause the removal of the action under 28 U.S.C. 1441. That statute provides that certain civil actions "may be removed by the defendant or the defendants, to the district court." See also Bush v. Cheaptickets, Inc., 425 F.3d 683, 686 (9th Cir. 2005) ("The removal statute, 28 U.S.C. 1441, is quite clear that only a 'defendant' may remove the action to federal court...."). On or before February 26, 2019 at 4:00 p.m., each side shall file a supplemental brief, not to exceed five pages, that addresses this question. Upon review of the supplemental briefing, a determination will be made as to whether the Motion will remain set for hearing on March 11, 2019, set for hearing on a different date, or taken under submission.
