MINUTE ORDER IN CHAMBERS - COURT ORDER by Judge Percy Anderson. The Complaint filed in this action asserts a claim for injunctive relief arising out of an alleged violation of the Americans with Disabilities Act ("ADA") and a claim for damages pursuant to California's Unruh Act. Because the Court possesses only supplemental jurisdiction over the Unruh Act claim, and in light of California's statutory efforts to curtail such claims, the Court ordered plaintiff to show cause in writing why the Court should exercise supplemental jurisdiction over the Unruh Act claim asserted in the Complaint. See 28 U.S.C. 1367(c)(2) & (c)(4). The Court has reviewed the Response filed by plaintiff and plaintiff's counsel (Docket No. 11) to the Court's Order to Show Cause (Docket No. 10). For all of the foregoing reasons, the Court, in its discretion, declines to exercise supplemental jurisdiction over plaintiff's Unruh Act claim. The Court therefore dismisses that claim without prejudice. (See document for details) (mrgo)
