Filing 24 (IN CHAMBERS) TEXT-ONLY ORDER RE SCHEDULING IN RELATED CASES by Judge John A. Kronstadt: This case has been deemed related to Albert Sarnoff et al. v. Silverado Senior Living, Inc. et al. ("Sarnoff"), No. 2:21-cv-00070-JAK-JPR. A scheduling order recently issued in Sarnoff. Counsel in all five related cases, as well as counsel in Sarnoff, shall meet and confer as to whether the schedule set in Sarnoff can also be adopted in the five related cases. The purpose of such a common schedule would be to conserve party and judicial resources as to both pre-trial and trial matters that are likely to present similar, if not identical, issues. On or before April 30, 2021, counsel in all six cases shall submit a single joint report that shall be filed separately in the docket of each of the cases, stating their respective and/or collective positions on the following matters: (1) whether the schedule set in Sarnoff should be adopted in each of the other five cases, and if not, what changes are proposed to those deadlines; and (2) whether a coordinated settlement process for all six cases with a single private neutral would be effective. As part of that submission, the parties shall state whether they have agreed on a single private neutral. If after sufficient discussions, they have been unable to agree on a single neutral, then Plaintiffs and Defendants shall each submit three nominees to the Court, including the c.v. and billing rates for each nominee. Based on a review of the joint report, the Court will determine whether to designate a single private neutral, and if so, which of the six nominees will be selected if parties have been unable to agree on a private neutral.
