MINUTE (In Chambers) Plaintiffs Failure to File Complaint Electronically (General Order 18-02) by Magistrate Judge Patricia Donahue: Pursuant to Rule 41(b) of the Federal Rules of Civil Procedure, an action may be subject to involuntary dismissal if a plaintiff "fails to prosecute or to comply with these rules or a court order. Accordingly, the Court could properly recommend dismissal of the action for Plaintiff's failure to timely comply with the July 8, 2021 and August 5, 2021 Orders. Plaintiff is again ordered to: (1) resubmit his Complaint, along with an application to proceed without prepayment of fees (CV-60P), a certified trust account statement, and disbursement authorization electronically by presenting it to the designated staff at his facility no later than September 10, 2021; or (2) filing a declaration signed under penalty of perjury, explaining why he cannot file the Complaint electronically and why he did not complete the disbursement authorization and attach a certified trust account statement as required in order to proceed without prepayment of fees.
