Filing 27 NOTIFICATION from Ninth Circuit Court of Appeals of case number assigned and briefing schedule. Appeal Docket No. 23-55256 assigned to Notice of Appeal to 9th Circuit Court of Appeals, #24 as to Plaintiff Danielle Victor. (mat) |
Filing 26 (IN CHAMBERS) ORDER RE: Motion for Appointment of Counsel [ECF No. 5] by Judge Maame Ewusi-Mensah Frimpong. The Court finds that the designation of counsel is not appropriate in this case at this stage. Accordingly, the Court DENIES Victor's Motion for Appointment of Counsel. It is possible that later on in the litigation, Victor may be able to make a sufficient showing of her likelihood of success on the merits and the ability to articulate her claims; if so, she may file a new motion for appointment of counsel. As a result of this Order, Victor remains unrepresented. Although the Court previouslyadvised Victor of her obligations as a pro se plaintiff, the Court reminds her that she nonethelessis required to comply with Court orders, the Local Rules, and the Federal Rules of CivilProcedure. See C.D. Cal. L.R. 83-2.2.3. The Local Rules are available on the Courts website, http://www.cacd.uscourts.gov/court-procedures/ local-rules. The Court cannot provide legal advice to any party, including pro se litigants, i.e., parties who are not represented by a lawyer. There is a free "Pro Se Clinic" that can provide information and guidance about many aspects of civil litigation in this Court. (See document for further details) (yl) |

The Court has reviewed the Request to Proceed In Forma Pauperis (the "Request") and the documents submitted with it. On the question of indigency, the Court finds that the party who filed the Request: has not submitted enough information for the Court to tell if the filer is able to pay the filing fees. This is what is missing: Plaintiff has not provided details about her current employment status, sources of income, assets, and dependents, if applicable. IT IS THEREFORE ORDERED that: Ruling on the Request is POSTPONED for 30 days so that the filer may provide additional information. IT IS FURTHER ORDERED that: Within 30 days of the date of this Order, the filer must do the following: Plaintiff must file an amended application to proceed in forma pauperis detailing her current employment status, sources of income, assets, and dependents, to the extent applicable.
