It is GRANTED with respect to: (1) the first claim of excessive force claim as it pertains to Officer Fowler; (2) the second claim of Municipal Liability against the City of Indio and the Indio Police Department; (3) the third claim of Substantive Due Process Violation against all Defendants; and (4) the fourth claim of Assault and Battery as it pertains to Officer Fowler in his individual capacity.
