ORDER to Dismiss With Prejudice by Judge Andrew J. Guilford. Based upon the stipulation #29 between the parties and their respective counsel, it is hereby ORDERED as follows: 1. The Court shall retain jurisdiction over this Action for the purpose of enforcing the terms of the parties' Settlement Agreement and entering the Stipulated Judgment pursuant to the terms of the Settlement Agreement and the Stipulation for Entry of Judgment in the event of a default; 2. The Court shall dismiss this action, with prejudice, on or after August 31, 2018, provided there has been no prior request for entry, or entry, of the Stipulated Judgment pursuant to the terms of the Settlement Agreement and the Stipulation for Entry of Judgment following a default; 3. The dismissal will be of the entire action, Case No. 8:16-CV-02164-AG-KES, including the Complaint and Counterclaim pursuant to Federal Rule of Civil Procedure 41(a)(1)(A)(ii), with prejudice with each party bearing its own attorneys' fees and costs.
