ORDER: (1) GRANTING FINAL APPROVAL OF CLASS ACTION SETTLEMENT; AND (2) ENTERING FINAL JUDGMENT by Judge James V. Selna, the Court hereby grants final approval of the Settlement, enters this Final Approval Order, and HEREBY ORDERS and MAKES DETERMINATIONS as follows: 9. The Court finds and determines that the Total Settlement Amount in the amount of $2,000,000 and the settlement payments to be paid to the Participating Class Members as provided for by the Settlement are fair and reasonable. 10. The Court finds and determines that the fees and expenses of KCC Class Action Services in administrating the settlement, in the amount of $126,000.00, are fair and reasonable. 11. The Court hereby grants final approval to and orders that the payment of the requested service award in the amount of $7,500.00 each to the Plaintiffs, $600,000 (30% of the Total Settlement Amount) for attorneys' fees to Class Counsel, and $124,781.33 for attorneys' litigation expenses be paid out of the Gross Settlement Fund in accordance with the Settlement. 20. The Parties are hereby ordered to comply with the terms of the Stipulation of Settlement. 21. This action is dismissed with prejudice as to the claims released by the settlement. Selna: It is hereby ORDERED: All claims in this action based on the allegation that Plaintiffs and the class of persons they seek to represent were required by Defendant to ride a shuttle bus from an off-site parking location to Disneyland Resort, specifically including claims for alleged unpaid wages and all derivative claims, shall be and hereby are dismissed as to Plaintiffs with prejudice and as to the putative class members without prejudice; Plaintiffs shall not present or attempt to present any evidence or argument in any paper or proceeding in this action related in any way to their dismissed mandatory shuttle-ride claims; and The parties shall bear their own attorneys' fees and costs incurred in connection with the mandatory shuttle-ride claims.
