ORDER ON REQUEST TO PROCEED IN FORMA PAUPERIS (NON-PRISONER CASE), Declaration in Support, #2 by Judge Valerie Baker Fairbank: The Court has reviewed the Request to Proceed In Forma Pauperis (the "Request") and the documents submitted with it. On the question of indigency, the Court finds that the party who filed the Request: Is not able to pay the filing fees. IT IS THEREFORE ORDERED that: Ruling on the Request is POSTPONED for 30 days so that the filer may provide additional information. IT IS FURTHER ORDERED that: Within 30 days of the date of this Order, the filer must do the following: File an amended complaint that can be fully comprehended. Any amended complaint shall (1) list all defendants in one place, on the first page, called the caption; (2) list each claim in a separately numbered paragraph or section; (3) specify which defendants should be held liable on each claim; (4) make clear which factual allegations are advanced to support each defendant's liability on each claim; (5) identify the provisions of the federal Constitution which were violated, and ( 6) identify the provisions of federal and state statutes which plaintiff contends were violated, if any. The amended complaint must be complete by itself; the amended complaint should not refer to or incorporate material from the original complaint. If the filer does not comply with these instructions within 30 days, this case will be DISMISSED without prejudice. (shb)
