January 6, 2023 Opinion or Order Filing 11 ORDER DENYING PLAINTIFF'S PETITION AND DISMISSING CASE by Judge Stanley Blumenfeld, Jr.: As indicated at the hearing on 1/6/2023, pursuant to the parties' representation that they appear to have reached an agreement on Plaintiff's petition #1 , the Court hereby DENIES the petition without prejudice and DISMISSES this action. The parties are hereby ORDERED to file their finalized agreement within 60 days of this order. The agreement and any subsequent filings related to Plaintiff's petition--including if Plaintiff chooses to refile her claim because the parties do not finalize an agreement--should be filed in the criminal case giving rise to the forfeiture at issue in this matter, Case No. 2:21-cr-00303-SB-1. Upon further consideration in camera (following the January 6th hearing), there is no need to file anything further in this case (including but not limited to the finalized agreement). (Made JS-6. December 1, 2022 Opinion or Order Filing 7 ORDER GRANTING APPLICATION TO PROCEED WITHOUT PAYING A FILING FEE #4 by Judge Stanley Blumenfeld, Jr. On November 28, 2022, Plaintiff Karen Ann Aviss filed an application to proceed in this action, in which she asserts rights to certain property subject to forfeiture, without paying a filing fee.
